Terms and Conditions for Studio Hire

Effective Date: 12 April 2025

By booking and using the studio facilities provided by Submerged Spaces, you (“the Client”)

agree to the following terms and conditions. Please read them carefully.

I. Definitions

  • “Submerged Spaces” / “Studio”: Refers to Submerged Spaces and any of its partners, employees, agents, or subcontractors.

  • “Client” / “Customer” / “Hirer”: Any individual, company, or entity hiring the Studio or engaging in services provided by Submerged Spaces.

  • “Services”: Includes all studio space, location facilities, and the services of personnel provided by Submerged Spaces or its subcontractors.

  • “Equipment”: Encompasses all fixtures, vehicles, lighting, and other materials provided by Submerged Spaces or its nominated subcontractors.

  • “Studio”: The premises of Submerged Spaces where services and equipment are provided.

II. General

  1. These Terms and Conditions constitute the entire agreement between Submerged Spaces and the Client. Any variations must be in writing and signed by an authorized

  2. representative of Submerged Spaces.

  3. Details of services, prices, and rates are available on the Studio website and may be subject to change without notice.

  4. Clients must inform Submerged Spaces if they require staff assistance during the booking. Additional charges may apply.

  5. Nothing in these Terms and Conditions is intended to exclude or limit liability for death or personal injury caused by negligence.

III. Studio Hire

  1. Bookings can be made provisionally via telephone, online, or email and must be confirmed within 24 hours by full payment.

  2. Clients must comply with all regulations governing the use of the Studio and Equipment.

  3. The Studio is for the exclusive use of the Client named in the booking and may not be sublet without prior written consent.

  4. Clients are responsible for removing all materials and rubbish at the end of the hire period. Disposal fees may apply for items left behind.

  5. No alterations or decorations are permitted without prior consent. The Studio must be returned in its original condition.

  6. The Studio is supplied clean. Clients must notify Submerged Spaces at the start of the hire period if any aspect is unacceptable.

  7. Setup and clean up time must be included within the booked hours to avoid overtime charges.

  8. Noise levels must be kept reasonable. Clients should consider other occupants and neighboring residents.

  9. No animals are allowed, except for guide dogs, unless agreed upon in advance.

  10. Smoking, vaping, and e-cigarettes are prohibited inside the Studio.

  11. Smoke and haze machines require prior approval.

  12. Illegal activities are strictly prohibited. Non-compliance may result in termination of the booking and involvement of authorities.

  13. The Studio is equipped with CCTV for security purposes. Tampering with security systems is a breach of these Terms and Conditions.

  14. For bookings involving vehicles, ensure tires are dry before entering the coved area.

IV. Equipment and Services

  1. Equipment and services are supplied at the Client’s risk. Submerged Spaces is not liable for loss or damage to materials or equipment.

  2. Equipment is provided in good condition. Clients must notify Submerged Spaces immediately if any issues are identified.

  3. Submerged Spaces is not liable for transport costs or any loss arising from the use or inability to use the Equipment.

  4. Clients may not:

  • o Remove Equipment from the premises without consent.

  • o Modify or tamper with Equipment.

  • o Use Equipment in a manner not recommended by the manufacturer.

  • o Allow untrained personnel to use the Equipment.

  1. Personnel provided by Submerged Spaces are deemed servants of the Client. Submerged Spaces is not liable for their actions.

  2. Submerged Spaces is not liable for any advice or instructions provided by its personnel.

  3. The hire period for Equipment cannot be extended without consent.

  4. Equipment must be returned promptly in good condition. Charges apply for lost or damaged Equipment.

V. Payment and Additional Charges

  1. Full payment is required before the commencement of the hire period unless otherwise agreed in writing.

  2. Overdue payments incur interest at 15% per week or part thereof.

  3. Hire time commences at the agreed start time and ends when the Studio and Equipment are returned.

  4. Additional Equipment, services, or modifications will be billed accordingly.

  5. Additional charges may apply for:

  • Damaged or dirty Studio conditions.

  • Repainting or redecorating.

  • Overtime usage.

  • Storage of items.

  • Breakage or missing items.

    6. A security deposit may be required, refundable upon satisfactory inspection.

    7. All rates are exclusive of VAT.

VI. Exclusions of Liability

Submerged Spaces is not liable for:

1. Loss or damage to Client property.

2. Breakdowns or failures of Studio facilities or Equipment.

3. Death or injury unless directly caused by negligence.

4. Fines or legal costs incurred by the Client.

5. Failure to comply with obligations due to circumstances beyond control. Clients are advised to secure appropriate insurance coverage.

VII. Indemnity

Clients shall indemnify Submerged Spaces against all claims arising from the use of the Studio or Equipment, except in cases of negligence causing death or personal injury.

VIII. Minors

Clients must ensure that individuals under 16 are accompanied by a chaperone and have

parental or guardian consent for participation.

IX. Booking Reschedule and Cancellations

  1. Bookings can be rescheduled free of charge if Submerged Spaces is notified at least 72 hours in advance.

  2. Cancellations made at least 72 hours before the booking date are eligible for a 50% refund.

  3. No refunds are provided for cancellations made less than 72 hours before the booking.

X. Termination

Submerged Spaces may terminate the hire contract if:

  1. The Client fails to make payments.

  2. The Client becomes insolvent or bankrupt.

  3. The Client breaches any terms of this agreement.

  4. The Client is more than 30 minutes late without prior notice.

XI. Additional Fees

Additional charges may apply for:

  1. Repainting the infinity cove.

  2. Redecorating due to scuffs or marks.

  3. Overtime usage.

  4. Cleaning if the Studio is not returned in a clean state.

  5. Storage of items.

  6. Breakage or missing items.

  7. Equipment rental.

  8. Printing services.

XII. Insurance Requirements

Clients are responsible for securing appropriate insurance, including public liability and equipment insurance. Submerged Spaces does not provide coverage for Client-owned

property or third-party damages.

XIII. Data Protection & Privacy (UK GDPR Compliance)

Submerged Spaces complies with the UK General Data Protection Regulation (UK GDPR). Personal data collected during the booking process is handled in accordance with our

Privacy Policy. CCTV footage is used for security purposes. For full details, please refer to our Privacy Policy.

XIV. Force Majeure

Submerged Spaces is not liable for failure to perform obligations due to events beyond its control, including natural
